Punjab Haryana High Court Major Relief That The Government Cannot Discontinue Increase Citing Retirement

After the directions of the Punjab Haryana High Court, now the government cannot deny the benefit of annual increment on one date to the employees who have completed one year of service on the last date of the month of retirement. The division bench of the High Court has issued these orders rejecting the appeal of the Punjab government against the orders of the single bench. If on the date of retirement of a Government servant one year has elapsed since his last increment, the Punjab Government shall deprive the employee of the benefit due on that date. The Government considers him retired on the last day of the month and on the first of the following month he is considered retired and deprived of the benefit of increment. After the instructions of the Punjab Haryana High Court, now the government cannot refuse to give the benefit of annual increment on one date to the employees who have completed one year of service on the last date of the month of retirement. The division bench of the High Court has issued these orders rejecting the appeal of the Punjab government against the orders of the single bench. Malghar Singh, a resident of Mohali, filed a petition in the single bench of the High Court through advocate Gitanjali Chhabra and said that if one year of the last increment is completed on the date of retirement of a government employee, then the Punjab government will pay the outstanding amount on the same date. The Government considers him retired on the last day of the month and on the first of the following month he is considered retired and deprived of the benefit of increment. ਪੰਜਬ ਹਰਿਆਣਾ ਹਾਈਕੋਰਟ ਦੇ ਨਿਰਦੇਸ਼ਾਂ ਦੇ ਬਾਅਦ ਹੁਣ ਸਰਕਾਰ ਸੇਵਾਮੁਕਤੀ ਦੇ ਮਹੀਨੇ ਦੀ ਆਖਰੀ ਤਰੀਕ ਨੂੰ ਇੱਕ ਸਾਲ ਦੀ ਸੇਵਾ ਪੂਰੀ ਕਰ ਚੁੱਕੇ ਮੁਲਾਜ਼ਮਾਂ ਨੂੰ ਇੱਕ ਤਰੀਕ 'ਤੇ ਸਾਲਾਨਾ ਇੰਕਰੀਮੈਂਟ ਦਾ ਲਾਭ ਦੇਣ ਤੋਂ ਇਨਕਾਰ ਨਹੀਂ ਕਰ ਸਕਦੀ। ਹਾਈ ਕੋਰਟ ਦੇ ਡਿਵੀਜ਼ਨ ਬੈਂਚ ਨੇ ਸਿੰਗਲ ਬੈਂਚ ਦੇ ਹੁਕਮਾਂ ਖ਼ਿਲਾਫ਼ ਪੰਜਾਬ ਸਰਕਾਰ ਦੀ ਅਪੀਲ ਨੂੰ ਰੱਦ ਕਰਦਿਆਂ ਇਹ ਹੁਕਮ ਜਾਰੀ ਕੀਤੇ ਹਨ। ਜੇਕਰ ਕਿਸੇ ਸਰਕਾਰੀ ਮੁਲਾਜ਼ਮ ਦੀ ਸੇਵਾ-ਮੁਕਤੀ ਦੀ ਮਿਤੀ ‘ਤੇ ਉਸ ਦੀ ਪਿਛਲੀ ਇਨਕਰੀਮੈਂਟ ਤੋਂ ਇੱਕ ਸਾਲ ਦਾ ਸਮਾਂ ਬੀਤ ਗਿਆ ਹੈ, ਤਾਂ ਪੰਜਾਬ ਸਰਕਾਰ ਕਰਮਚਾਰੀ ਨੂੰ ਉਸ ਮਿਤੀ ਨੂੰ ਮਿਲਣ ਵਾਲੇ ਲਾਭ ਤੋਂ ਵਾਂਝਾ ਕਰ ਦਿੰਦੀ ਹੈ। ਸਰਕਾਰ ਉਸ ਨੂੰ ਮਹੀਨੇ ਦੇ ਆਖ਼ਰੀ ਦਿਨ ਸੇਵਾਮੁਕਤ ਮੰਨਦੀ ਹੈ ਅਤੇ ਅਗਲੇ ਮਹੀਨੇ ਦੀ ਪਹਿਲੀ ਤਰੀਕ ਨੂੰ ਉਸ ਨੂੰ ਸੇਵਾਮੁਕਤ ਮੰਨਿਆ ਜਾਂਦਾ ਹੈ ਅਤੇ ਵਾਧੇ ਦੇ ਲਾਭ ਤੋਂ ਵਾਂਝਾ ਰੱਖਿਆ ਜਾਂਦਾ ਹੈ। ਪੰਜਬ ਹਰਿਆਣਾ ਹਾਈਕੋਰਟ ਦੇ ਨਿਰਦੇਸ਼ਾਂ ਦੇ ਬਾਅਦ ਹੁਣ ਸਰਕਾਰ ਸੇਵਾਮੁਕਤੀ ਦੇ ਮਹੀਨੇ ਦੀ ਆਖਰੀ ਤਰੀਕ ਨੂੰ ਇੱਕ ਸਾਲ ਦੀ ਸੇਵਾ ਪੂਰੀ ਕਰ ਚੁੱਕੇ ਮੁਲਾਜ਼ਮਾਂ ਨੂੰ ਇੱਕ ਤਰੀਕ ‘ਤੇ ਸਾਲਾਨਾ ਇੰਕਰੀਮੈਂਟ ਦਾ ਲਾਭ ਦੇਣ ਤੋਂ ਇਨਕਾਰ ਨਹੀਂ ਕਰ ਸਕਦੀ। ਹਾਈ ਕੋਰਟ ਦੇ ਡਿਵੀਜ਼ਨ ਬੈਂਚ ਨੇ ਸਿੰਗਲ ਬੈਂਚ ਦੇ ਹੁਕਮਾਂ ਖ਼ਿਲਾਫ਼ ਪੰਜਾਬ ਸਰਕਾਰ ਦੀ ਅਪੀਲ ਨੂੰ ਰੱਦ ਕਰਦਿਆਂ ਇਹ ਹੁਕਮ ਜਾਰੀ ਕੀਤੇ ਹਨ। ਮੁਹਾਲੀ ਵਾਸੀ ਮਲਘਰ ਸਿੰਘ ਨੇ ਹਾਈਕੋਰਟ ਦੇ ਸਿੰਗਲ ਬੈਂਚ ਵਿੱਚ ਐਡਵੋਕੇਟ ਗੀਤਾਂਜਲੀ ਛਾਬੜਾ ਰਾਹੀਂ ਪਟੀਸ਼ਨ ਦਾਇਰ ਕਰਦਿਆਂ ਕਿਹਾ ਕਿ ਜੇਕਰ ਕਿਸੇ ਸਰਕਾਰੀ ਮੁਲਾਜ਼ਮ ਦੀ ਸੇਵਾਮੁਕਤੀ ਦੀ ਮਿਤੀ ਨੂੰ ਆਖਰੀ ਇੰਕਰੀਮੈਂਟ ਦਾ ਇੱਕ ਸਾਲ ਪੂਰਾ ਹੋ ਜਾਂਦਾ ਹੈ ਤਾਂ ਉਸੇ ਮਿਤੀ ‘ਤੇ ਬਕਾਇਆ ਰਕਮ ਪੰਜਾਬ ਸਰਕਾਰ ਅਦਾਇਗੀ ਕਰੇਗੀ। ਸਰਕਾਰ ਉਸ ਨੂੰ ਮਹੀਨੇ ਦੇ ਆਖ਼ਰੀ ਦਿਨ ਸੇਵਾਮੁਕਤ ਮੰਨਦੀ ਹੈ ਅਤੇ ਅਗਲੇ ਮਹੀਨੇ ਦੀ ਪਹਿਲੀ ਤਰੀਕ ਨੂੰ ਉਸ ਨੂੰ ਸੇਵਾਮੁਕਤ ਮੰਨਿਆ ਜਾਂਦਾ ਹੈ ਅਤੇ ਵਾਧੇ ਦੇ ਲਾਭ ਤੋਂ ਵਾਂਝਾ ਰੱਖਿਆ ਜਾਂਦਾ ਹੈ। ਪਹਿਲੀ ਤਰੀਕ ਤੋਂ ਮੁਲਾਜ਼ਮ ਹੈ ਹੱਕਦਾਰ-HC
ਪਟੀਸ਼ਨਕਰਤਾ ਨੇ ਕਿਹਾ ਕਿ ਉਸ ਨੂੰ ਆਪਣੇ ਪੂਰੇ ਸੇਵਾ ਕਾਲ ਦੌਰਾਨ ਤਨਖਾਹ ਵਾਧੇ ਦਾ ਲਾਭ ਮਿਲਦਾ ਹੈ ਅਤੇ ਜਦੋਂ ਸੇਵਾਮੁਕਤੀ ਦਾ ਸਮਾਂ ਆਉਂਦਾ ਹੈ ਤਾਂ ਉਸ ਨੂੰ ਇਕ ਦਿਨ ਦੀ ਦਰਖਾਸਤ ‘ਤੇ ਵਾਧਾ ਦੇਣ ਤੋਂ ਇਨਕਾਰ ਕਰ ਦਿੱਤਾ ਜਾਂਦਾ ਹੈ। ਹਾਈਕੋਰਟ ਦੇ ਸਿੰਗਲ ਬੈਂਚ ਨੇ ਪੰਜਾਬ ਸਰਕਾਰ ਨੂੰ ਹੁਕਮ ਦਿੱਤਾ ਸੀ ਕਿ ਜੇਕਰ ਸੇਵਾਮੁਕਤੀ ਦੀ ਮਿਤੀ ਤੋਂ ਉਸਦੀ ਆਖਰੀ ਇਨਕਰੀਮੈਂਟ ਤੋਂ ਇੱਕ ਸਾਲ ਦਾ ਸਮਾਂ ਬੀਤ ਗਿਆ ਹੈ, ਤਾਂ ਕਰਮਚਾਰੀ ਪਹਿਲੀ ਤਾਰੀਖ ਨੂੰ ਮਿਲਣ ਵਾਲੀ ਸਾਲਾਨਾ ਇਨਕਰੀਮੈਂਟ ਦਾ ਹੱਕਦਾਰ ਹੈ। ਹਾਈ ਕੋਰਟ ਦੇ ਹੁਕਮਾਂ ਕਾਰਨ ਮਿਲੇ ਵਾਧੇ ਦਾ ਸਿੱਧਾ ਅਸਰ ਮੁਲਾਜ਼ਮਾਂ ਦੇ ਸੇਵਾਮੁਕਤੀ ਲਾਭਾਂ ‘ਤੇ ਪੈਂਦਾ ਹੈ। 2022 ਵਿੱਚ ਪੰਜਾਬ ਸਰਕਾਰ ਨੇ ਸਿੰਗਲ ਬੈਂਚ ਦੇ ਇਸ ਫੈਸਲੇ ਵਿਰੁੱਧ ਡਿਵੀਜ਼ਨ ਬੈਂਚ ਵਿੱਚ ਅਪੀਲ ਦਾਇਰ ਕੀਤੀ ਸੀ। ਮੰਗਲਵਾਰ ਨੂੰ ਹਾਈ ਕੋਰਟ ਨੇ ਪੰਜਾਬ ਸਰਕਾਰ ਦੀ ਅਪੀਲ ਨੂੰ ਰੱਦ ਕਰਦਿਆਂ ਸਿੰਗਲ ਬੈਂਚ ਦੇ ਹੁਕਮਾਂ ਨੂੰ ਮਨਜ਼ੂਰ ਕਰ ਲਿਆ।
